日本学術会議委員の任命拒絶は、何が問題なのか(What is the problem with the Science Council of Japan's death call?)

 最近、菅義偉首相の日本学術会議委員の任命拒否が話題になっています。そもそも、何が問題なのでしょうか?個人的には大問題だと思っていますが、あまりピンと来ない人もいるかもしれません。事の発端は、日本学術会議が推薦した同会議の会員候補者105名のうち6名の任命を管首相が拒絶し、残りの99名のみ任命したことに始まります。6名の中には、東京慈恵医大の小沢隆一教授、早稲田大学の岡田正則教授、立命館大学の松宮孝明教授、東京大学の加藤陽子教授の名前が挙がっています。拒否された学者の全員が、かつて政府の政策に異論を唱えた人たちです。例えば、小沢教授は2015年、安保法制をめぐる国会での中央公聴会で『憲法違反だ』と述べました。また岡田教授は「安全保障関連法案の廃止を求める早稲田大学有志の会」の呼び掛け人の1人です。2018年、沖縄県名護市辺野古の米軍新基地建設問題を巡って、他の学者らとともに政府の対応に抗議する声明を発表しました。全て、日本政府の安保政策や沖縄の基地問題に異論を唱えた人たちです。政府の政策に異論を唱える学者は許さないという自民党政府の方針です。

 

今回の拒否問題は、日本の最高裁裁判官の任命と同じ構造です。

 

 地方裁判所はともかく、高等裁判所などの裁判官の中では、政府の指針に反する判決を出す裁判官はほとんど居ません。それは、最高裁判所の裁判官の任命権が内閣にあることに起因します。政府の指針や政策に反する判決を出す裁判官は、出世できず最高裁の裁判官にはなれません。国を訴えた裁判の中で、国が敗訴する例がほとんどないことは良く知られています。これは、裁判官が自分の出世に響く判決をしないからです。一生、地方裁判所や家庭裁判所の裁判官で終わりたい人は、居ないでしょう。国に忖度しないと、裁判官も生きていけない世界です。これを日本の学者にも適応しているのです。つまり、学者も政府の指針に沿った意見を強要し、忖度しろと言っているのです。

 

果たして日本政府は「絶対正義」なのか?

 

 時折、左派の人たちに見られる「絶対正義」の主張があります。「私(達)の意見は絶対正しく、異論は許さず、異論を述べる者はレッテルを張って排除する。」という主張です。今回の任命拒絶問題は、非常に類似しています。日本政府のやることは絶対に正しく、反論する学者は除外するという態度が見えています。これを日本政府のレベルで行った場合、権力が伴うため、様々な問題が出てきます。任命拒絶は、違法と言う指摘もあります。個人的には、「反対意見でも飲み込む度量」を管首相に期待したいと思います。

All are those who disagree with the Japanese government's security policy and the Okinawa base issue. It is the policy of the LDP government that scholars who disagree with the government policy are not allowed.

 

This refusal issue has the same structure as the appointment of a Japanese Supreme Court judge.

 

 Aside from the district court, few judges, such as the High Court, issue judgments that violate government guidelines. It is due to the fact that the Cabinet has the right to appoint judges of the Supreme Court. Judges who issue judgments that violate government guidelines and policies cannot advance and become Supreme Court judges. It is well known that there are few cases in which a country loses in a court case against a country. This is because the judge does not make a judgment that affects his career. No one wants to end up as a district court or family court judge for the rest of their lives. It is a world where judges cannot live unless they are in the country. This is also applied to Japanese scholars. In other words, scholars are also coercing opinions in line with government guidelines and telling them to be sontaku.

 

Is the Japanese government "absolute justice"?

The claim is that "our opinion is absolutely correct, no objection is allowed, and those who disagree are labeled and excluded." The issue of refusal to appoint this time is very similar. The Japanese government is absolutely right in what it does, and it seems that scholars who argue against it are excluded. If this is done at the level of the Japanese government, there will be various problems due to the power involved. It has been pointed out that refusal to appoint is illegal. Personally, I would like to expect the Prime Minister to "swallow even dissenting opinions."
